I use Nathan. He was not as clear as he could’ve been. I had to call in to get details that I got it to him and still took him two weeks to get me my money back from my house sale. I thought I’d be fair and give them a chance to do my WILLS First meeting was October 28 by phone I since had to call in three times to try to talk to him he has as of writing this not responded November 10 now I do not recommend

Mr. Fuller was appointed executor in my aunt’s Will; Brimage Law Group were identified as “solicitor for the estate”. My mother was one of thirteen beneficiaries (including bequests); I am the estate trustee for my now-deceased mother’s estate. There were no disputes amongst beneficiaries. The estate value exceeded $2 million and consisted only of a chequing account, one investment account and less than $1,000 in personal possessions. There were no debts to be settled.

He failed to provide a valuation (sum of one bank and one investment account) as of the date my mother died. He told me to use a figure of $200,000 when the actual value was in excess of $400,000. If audited, I face potential fines or jail time because I was unable to accurately report the value of my mom’s estate.

Brimage wrote to beneficiaries in February 2024, enclosing a set of accounts and a draft Release to be signed. The letter stated “Should the Estate not receive signed Releases from all beneficiaries then prior to any further distributions, the Estate will be required to pass accounts in Court, the extensive costs of which will be payable by the Estate and reduce the eventual amount to be distributed.” He followed through on that warning despite knowing his accounts were wrong.

Those accounts were incorrect, as confirmed when a new set of accounts was submitted in July 2024. An analysis indicated that for the period of the original accounts, there were three transactions where the wrong transaction date was reported, two transactions where the amount reported was wrong, five items in the original accounts that weren’t in the corrected accounts, six transactions that were misclassified, and eighteen transactions in the corrected accounts that were totally missing from the original accounts. In total, $74,498.14 worth of transactions were either incorrectly included in the original accounts or missed in the original accounts. These were not minor mistakes.

The draft Release also contained many errors. The release was entitled “Final Release” and sought to release Mr. Fuller for his actions “at any time whatsoever” (including in the future), even though the estate was not close to being finalized. My name was misspelled – with two different misspellings – at three instances in the document; even Mr. Fuller’s name did not appear properly at one instance. My mailing address was also incorrect. Also importantly, the release (as drafted) would have allowed Mr. Fuller to pay himself the entirety of his fee immediately, whereas the estate trustee’s fee should only be paid upon finalization of the estate.

I asked various questions about the erroneous accounts and requested four supporting documents (invoices); Mr. Fuller only provided two of those documents. In respect of the request for the other two documents, Mr. Fuller responded, writing “Please note that we are not prepared to entertain further back and forth regarding the accounts. Should you not be satisfied at this time, the Estate will be engaging outside legal counsel to proceed to a passing of accounts”. That message, from March 8th 2024 was the last correspondence received from Mr. Fuller. He severed all contact with beneficiaries and appointed an external lawyer to correct and resubmit accounts to the beneficiaries. So far, that external lawyer has incurred well in excess of $12,000 in costs.

My aunt passed in mid November 2022; it took Mr. Fuller until 3rd April 2023 (4.5 months) to apply for probate, even though he engaged Brimage – at a cost to the estate of $3,800 – to do this work. It took him until about January 30th 2024 – over 14 months after my aunt’s passing –to advertise for creditors. And an invoice for health care services issued on 14th November 2022 didn’t get paid until August 10th 2023, nearly 9 months later; luckily the estate was not charged interest on the amount.

I wrote to all of the other lawyers at Brimage to alert them to some of Mr. Fuller’s actions in the administration of this estate 
 none of them acknowledged my email.

I hired Cyrus Muller to handle my separation. I had done my own research prior to see how assets are typically divided and how child custody payments are calculated. Cyrus told me the same as everything I had read and assured me it was a simple case. When he drafted the agreement he had me paying full support even custody is legally 50/50 and we both made approximately the same income. I kept very detailed notes of all of our conversations so I could refer back to them later for clarity. Cyrus denied saying any of the things he told me previously. When I voiced my displeasure and called him out for retracting what he had told me he suggested I find other representation. He however had no problem keeping the thousands of dollars I paid him to basically do nothing but say what I wanted to hear just to do the opposite. I hired a different law firm from out of town that handled my case properly, professionally for less money in less time.
